Novorossiysk Commercial Sea Port (NCSP) released operating results for the three quarters of 2009. During this period the company's turnover increased by 8,1%. This liquid cargo turnover increased by 7,5%, bulk - by 62,5%, while container throughput decreased by 38,7%. We appreciate the operating results of the NCSP as moderately positive. In particular, the turnover of the NCSP continues to grow faster than the average for the sector. According to the Association of Sea Commercial Ports of Russia, seaports cargo turnover of Russia increased in January-August 2009, at 6,5% compared to the same period last year. An even more optimistic about the operating results of the NCSP seen against the background of all freight transport in Russia, which has declined over the 8 months of this year to 17,5%. The Arbitration Court of Stavropol region on Oct. 13, 2009 invalidated a notice of OAO WGC-2 on the dissolution of contract for services with OJSC E4 Group on the project to build two power plants in Stavropol TPP that OGK-2 in April 2009 sent to Address Group E4. The notice demanded the return of unspent funds. Thus, the court upheld the claims of Group E4. The court has reduced the chances of WGC-2 to terminate the contract and return the funds paid by the Group E4. Because of the trials of OGK-2 does not fit within the terms of the investment obligations for the construction of new facilities that eventually could lead to sanctions against the WGC-2 by Ministry of Energy.
