National Bank of Ukraine from November 15, enters the marginal rate for external borrowing in foreign currency
Oct 21st, 2009 | By admin | Category: Main Newsin Ukraine since 15 November 2009 shall come into effect limiting the size of the interest rates, taking into account commissions, penalties and other fees for short-, medium-and long-term foreign borrowings of residents in the form of credits and loans in foreign currency, in effect until October 27 2008 by decree of the National Bank of Ukraine dated August 3, 2004 № 363 On establishing the interest rates on external borrowing of the resident. This is stated in a letter to the National Bank.
The item is enshrined in the NBU Board dated October 15, 2009 № 614 On certain aspects of the registration of credit agreements (contracts, loans) in foreign exchange of prisoners between residents and non-borrowers, which takes effect from 15 November 2009 decree number 614, in particular, provides for cancellation of orders of the National Bank from September 25, 2008 № 294 On Amending Resolution of the National Bank of Ukraine dated August 3, 2004 363.
In addition, the decree number 614 established that the National Bank of Ukraine shall register the change in the loan agreement (loan agreement) in foreign currency, made between the borrower and the resident-nonresident and registered in accordance with the Regulation on the conditions for residents of credits, loans foreign currency from non-residents and residents of foreign currency loans to non-residents, approved by the NBU Board dated June 17, 2004 number 270, before the entry into force of the decree number 614, on the basis of additional agreements, provided that the amount to be paid for using credit (loans) such a treaty with the additional agreements shall not exceed the amount specified by the maximum interest rate (except in cases where changes in previously registered agreement providing for a higher reimbursement rate for using credit than the maximum interest rate established in accordance with claim 1 order number 614, are limited to a name change , location and /or bank details rezidenta-zaemschika/nerezidenta-kreditora, or relate to the transfer duty on non-resident under the contract).
In accordance with the document, banks are required to bring the size of the maximum interest rates for short-, medium-and long-term foreign borrowings of residents in the form of credits and loans in foreign currency, which will operate from November 15, 2009, to the knowledge of customers.
