In Ukraine, you may receive a special Bureau of Investigation
Jul 30th, 2009 | By admin | Category: Main Newsyesterday in the Verkhovna Rada has registered a bill on the National Anti-Corruption Bureau of Investigation. Its developers are MPs of all parliamentary factions: Alexander Ryabeka, Grigory Omelchenko (both - BYT), Nikolai jig (the Party of Regions), Igor Kaletnik (the faction of the Communist Party), Oleg Zarubinsky (block Litvina), Yuri Karmazin and Gennady Moskal (both - Our Ukraine-People's Self-Defense).
MPs propose to create a fundamentally new structure - the National Anti-Corruption Bureau of Investigation, which will be the central organ of executive power with law enforcement functions. The goal is that the bureau will have a narrow specialization and focus on the identification and investigation of corruption among top officials.
Specifically, NBAR will be investigating cases of embezzlement of property with the use of official position, the laundering of proceeds of crime, abuse of office, summer house /receiving bribes, illicit enrichment, abuse of power, pressure on the judiciary. In addition, the NBAR will investigate the crime, the harm as a result of which more than 480 thousand UAH, as well as crimes against officials of foreign governments and international organizations.
- This bill takes into account all the European standards to combat corruption. The body, which is proposed to be a small, brief and will be able to use all the power structures - Ryabeka said.
Structure
office will include one central and 11 regional offices. The authors of the bill proposes to approve the staffing of the National Bureau with the upper threshold of 1300 persons, 420-450 of whom will work at the central office, and 65-70 - in the regional. With this staffing of each regional administration NBAR will monitor the activities of 5200-7800 officers, who could potentially commit the crime of corruption. The goal is that NBAR will be equipped with state of the units engaged in combating corruption in the structures of the Interior Ministry, Security Service and Prosecutor's Office.
Director of the Bureau will appoint a Cabinet after the respective competition, competitive commission headed by the Prime Minister and its membership will consist of the five People's Deputies, members of the committee on combating organized crime and corruption, the Minister of Justice, the Prosecutor General, a representative of the President and two representatives Council of Judges. NBAR Manager will be appointed for five years without the right to hold this position for two terms in succession. Heads of regional offices will be appointed director of NBAR.
Among other things, the bill provides for the establishment of the bureau of internal security, which will monitor violations of the service staff NBAR. The investigation of corruption cases against members of the Bureau of Ministry of Internal Affairs investigators will work.
authors of the document claim that its implementation does not require additional funding from the state budget. It is anticipated that a portion of the cost of the logistics of providing the special anti-organized crime and corruption, the Interior Ministry, Security Service and Prosecutor's Office will be redirected to NBAR.
- General Prosecutor's Office is one of the initiators of the project. The recent anti-corruption legislation, which will take effect from next year, provided that the investigation should hold a special body - said Deputy Prosecutor General Alexander SHYNALSKYI .- I am also impressed by the initiative that the office should complete the most qualified investigators prosecutors, police and Security Service.
Minister of Internal Affairs Yuriy Lutsenko recognizes the need for a separate structure to combat corruption, but finds that it would be logical to create such a body in the structure of the MIA.
- In my opinion, anti-corruption bureau to be established within the Ministry of Internal Affairs, regardless of who is a minister - said the head of the MVD .- When the unit is stronger and stand on their feet, it can be somewhat distanced itself from the Ministry of Internal Affairs. If you build it from scratch, it would not have the necessary operational information and, accordingly, will float. Therefore, the correct way is very simple - to create anti-corruption agency based UBOPa strengthen its investigators and the Prosecutor General on particularly important matters.
noteworthy that this was the fourth attempt to create anti-corruption bureau. People's deputy Gennady Moskal - author of three of the four bills on anti-corruption agencies - believed that the current version is more likely to take.
- The text of the bill by 75% of the repeats, which I recorded in 2008. We brought together representatives of all factions and made constructive suggestions. For example, a very good idea - hold a competition among applicants for the position of Director - reported yesterday Moskal .- Because of the bill was signed by representatives of all parliamentary factions, but now they must work with their MPs to fall we have already discussed it in the first reading.
